Maternity benefit

I am employee of CA firm,i put maternity leave application so my boss told me,this benefit act not applicable on us,just humanity paid 1month salary,now what I do?

If the law is not applicable to the organisation, there is nothing you can do. Just keep a siblings face and bear it.

What are the rules of the Firm? If the rules are not permitted, how can your boss grant maternity leave? On humanitarian grounds he is sanctioning one month salary. Enjoy it. Be happy. don't think about this.

The CA firm is right being a private professional proprietary or company but not an organisation to oblige you with maternity benefit as applicable in government departments/ PSUs.

THE MATERNITY BENEFIT ACT, 1961

THE MATERNITY BENEFIT (AMENEDMENT) ACT, 2017
are simple to understand.
The applicability of the Act is duly explained.

e.g; In case of establishment covered by Shops & Establishments Act of the state; if 10 or more employes were/are employed.

Then the State Act might cover CA’s firm or IT may not!

If the establishment is not covered as posted in query per claim of employuer then employer has shown big heart and offered to pay an amount.

Rest check with Inspector appointed under the Act and/or Labor Inspector …..even seasoned employee’s/trade union leaders.

You may try for coverage under ESIC from employer (volountray).
Or buy Health Insurance that covers maternity and related preganc delivery.
Lot of information si available at internet , company websites for such policies e.g;
The standard add-on of a maternity policy covers the cost of delivery. Hospitalization expenses linked to either normal or caesarean delivery can be claimed under the policy. Any complication arising in the delivery such as need for forceps delivery will be covered. Major life threatening complications such as ectopic pregnancy will be covered beyond the maternity add-on limit and within the overall policy sum assured. Miscarriage is also covered under the policy.

Voluntary termination of pregnancy is generally not covered. Further, in select situations doctors may advise hospitalization only for the purpose of observation or diagnostics. Such instances are not covered by the policy. It is necessary that some treatment should have been delivered for a claim to be admissible.
