Process of tamilnadu land ceiling

Hi,

We have a vacant land of 1200 SQFT near Pallikaranai (Madipakkam village), Chennai. We recently came to know that our land is under ceiling and we should get approval in order to sell the land. Land was purchased in 1992. Seller and my parents are not aware of this while buying. We're really concerned with this matter. We have patta still in the name of Seller. My questions are
1) Nearby plots is build up area. Do we really need to worry in this matter?
2) How to confirm whether it is under ceiling or not ?
3) Process of getting approval in order to sell the land or use it for our purpose.

I will be very grateful, if you can help me with this.

Go to urban Land Ceiling Office of the concerned area with survey number and plot number of your plot and they would confirm immediately the real status.Then post it in the same thread please. Keep paying the related taxes up to date promptly

If a genuine Patta is there there are possibilities of you winning the case if you file, Refer the judgement in the case od " R.Ramesh Vs State of Tamilnadu on 22nd Dec 2014 pronounced by Justice C.S.Karnan Madras High Court " which is very similar to your case please.

'Buyer Beware' applies to property deals.
It shall be appropriate to get proper legal opinion from a very able LOCAL senior counsel of unshakable repute and integrity specializing in revenue/property/civil/DRT matters and well versed with LOCAL applicable rules/laws and having successful track record…. and worth his/her salt , before signing or making payment.
This may cost some FEE but can defend long term interest and hard earned monies.

Obtain proper legal opinion in writing.

You may take help of elders of your family, competent and experienced well wishers, seasoned PIP’s, helpgroups, community leaders, NGO’s, experienced colleagues, associations, religious scholars/leaders, influential persons etc and/or find a very able LOCAL counsel/Law firm specializing in concerned filed of law e.g; Revenue/Civil matters as in your case, and well versed with LOCAL applicable rules, precedence, latest judgments etc …. and worth his/her salt, can advise you after examining all case related docs, inputs, evidences on record.
One should not fall for IT’s and entities loitering at online portals to allure unsuspecting querists. There are many threads on such instances at LCI also.
Online discussions are not substitute to in person discussions with a very able counsel of unshakable repute and integrity specializing in concerned field of law.
There are such very able counsels at each location.
Check for such counsels at LOCAL e.g; Revenue/Civil courts, HC, SC …
Show all docs and obtain proper written legal opinion.
You can also try for FREE legal Aid from Legal aid center (DLSA) that is usually within LOCAL courts complex..preferably from a very able counsel specializing in Revenue/Civil matters.

If entire land was under some ceiling then all are affected.
If there was any concealment while selling the land to you you may have a reason to agitate against seller..

Presently Tamilnadu government had provided an option owners having such lands under ceiling could pay the penalty and could regularize the land . Check with the concerned department and proceed please.
