Adoption of sister's child- Christian

(Querist) 01 July 2018 This query is : Resolved
Hi,
My husband and I would like to adopt/become legal gaurdian of my nephew.
His parents are going through a divorce and both of them do not have capacity financially to take care of the child.
My sister works in a school and looks after my sick mother while her husband has lost his job and is an alcoholic.
My nephew 7 years old has been staying with us for over a year now. My husband has quit his job to take care of our home. We dont have children of our own.
I have a great job and travel quite a bit, am unable to take my nephew abroad or get benefits for him that my company provides while abroad like education as he is legally not mine.
I would like him to have the best of the worlds and be one as a family.
My husband and I are 38 years old.
Requesting advice. Thank you

Discuss with a Local good Advocate and comply with the formalities of procedures and adoption.

There are no specific law authorising adoption among Christians. However, it has been held that there is no legal provision or Cannon Law that interdicts adoption of a child by a Christian couple. The prevailing legal position is that Christians in India can adopt children by resort to section 41 of the Juvenile Justice (Care and Protection of Children) Act 2006 read with the Guidelines and Rules issued by various State Governments. Apart from that there are customary laws permitting them to adopt children especially in Punjab.
