Complainant refused the summons

Querist : Anonymous (Querist) 07 June 2018 This query is : Resolved 
Complainant refused the summons sent by prosecution for his evidence in FIR case which was lodged on his complaint. "Inkaari" id written on summons.......

Kindly guide on what will be the future course of action ....

Whether the name of the complainant be removed from the PWs list

Whether complainant will be bound by court to come and give evidence.....if yes whether bailable or nbw will be issued by court

If the defence want to examine the complainant as his evidence can prove that the FIR is false..can he be called as witness by defence.....

Whether such calling as above will prejudice the rights or case of defence....

Complainant is the main witness in FIR criminal complaint case and he's not appearing for recording his evidence in court proceedings than the complaint case will be ultimately dismissed by the judge dealing the case if no other eye witness or informal witness exists for recording evidence.
The other witnesses are usually the police officials who are formal witnesses.

As the complainant is the main witness of the FIR case to give evidence. His non appearance to give evidence in his own case will make the court dismiss the prosecution case as he is key witness for the prosecution as no other eye or informal witness are there..Police are formal witnesses.

Complainant has to appear to give evidence. The court should issue NBW. Then his case will not be dismissed.
