if husband and wife name is mentioned in the purchase agreement then does the wife has any right in the property
we both are divorced now but no where in the purchase deed it is mentioned that she is joint owner
in the divorce paper she has mentioned that she will not claim for any of my moveable or immoveable property

Agreement has no role to play after the execution of sale deed. You are safe, if name of your wife does not appear in the sale deed.

To the extent of 50% ownership wife has to execute relinquishment deed with respect to joint ownership in sale deed which should be duly stamped and registered. .

Dear Usha Mam,

She is not in good terms with me. So what is the way out. As she is the one who wanted a divorce and live a independent life. As per divorce deed I have paid for 2 years and I am taking care of my kids expenses only. Without initmating me she has removed him from the school too and expecting too pay her expenses too till she is settled. We had executed a mutual divorce as she wanted to go through it. I am the one who is paying the emi as the loan is in my name.

Sale agreement do not convey any title nor create any interest in an any immovable property so no question of ownership of wife arises as suggested by Mrs kapoor. No r�quirement to get execution of relinquishment deed.
