Power of attorney

(Querist) 13 April 2018 This query is : Resolved
My aunt has given the power to my uncle (her husband) to deal with her property through power of attorney. The power of attorney is a registered.

Now, is it possible, through the power of attorney, to transfer the property to my uncle's name.

If so, what are the legal formalities.
RAJALAKSHMI (Querist) 13 April 2018
Power of attorney

I think you have not come out with real facts and issues.
One has to know as to what is the Power of Attorney is about. What powers have been granted by your Aunt in the power of attorney.
Further, it is not understood why the property has to be transferred from your Aunt to your Uncle? Whether your uncle will make any payment (consideration) for the property to your Aunt?

Yes the POA is Legally Valid to effect the Transfer in the name of Holder of POA also.

If your Aunt gave POA to sale/gift/lease etc., then he(your uncle) has power to transfer the property in his name. it is better to consult your counsel with the POA. He will guide you.

I Agree with KovakSatyanarayana.

Show the document of PoA to a local prudent lawyer to analyse its covenants, advise and proceed.
Nothing can be presumed to form an opinion and advise.
