Legal Property Documents

My Grandmother is an individual owner of a plot.
She has lost all the property documents and is now left only with society share certificate.The plot is old(1981).She has two sons and three daughters.
She now stays with younger son.(from past 30 years approx).
The Property Documents are old so the documents are lost at sub registrar office as well as in the Society.
She suspects the original documents are with her elder son.
She has asked him to handover the documents verbally but in reply the elder son says that he is still searching for the documents and will give it when he finds it.
How can she extract the documents from the elder son without any problems.

You can get copy from the Registrar's office.

You can get certified copies of will from Registration Dept or Sub registrar which are as good as original.

What is the WILL that you are talking about.
The querist is concerned about the original documents of the property and not any WILL.

You are right, from where the question of "WILL" appears? In fact, the lady is habitual in creating one or the other controversy through her thoughtless replies on the queries. If question pertains to east, she prefers to reply about west.

First make genuine efforts and get the copy of documents and up to date EC.

Then A Police Complaint and News Paper Advt to be made regarding Missing Original Documents.

Then A Suit to be filed in the concerned Court and after verification with concerned Registrar and others the Court would declare Originals as Lost and would endorse the certified copy of documents obtained from Registrar with Court Seal. From then it would be treated as Original.

To Whom So ever it may Concern_ There is No query about any Will here. Also the Certified Copies of any Will Can not be obtained with out a Valid Proof of demise of the Executor. Will is a document which could be cancelled. or altered or modified as many times as per the wishes of the Executor during his life time.

In this case the documents are lost in registrar office and in the Society as well. I have personally searched each and every document in both(registrar and society�s) offices.So the documents are only left with elder son( which she suspects to be with).I am searching documents in both the offices from past 3 years.

How the Sub Registrar Office would permit you to search the documents in their Govt Office. First submit a Pleading application for copy of documents to the concerned Registrar marking copy to the IG of Registrar . You could apply thro RTI for which you would get the reply in 30 days You should make the submission of pleading application atleast with some details and correct year of execution.. Un less and until your brother is co operative even if you make a Police Complaint he could just walk away saying that he do not have.

Original documents also if they are registered you can obtain certified copies from registrar or REGISTRATION DEPARTMENT.

I disagree with author, the documents can NEVER be said to have been lost in the office of Sub-Registrar, if the same were registered.
Either the story is fake and fabricated for the purpose of academic debate or the alleged theft and lost document story is false.
