about affidavit in pvt.complaint case under 156(3)

after 2015 supreme Court judgement of priyanka shrivastav vs.state of u.p.it has become necessary that a Pvt.complaint should be filed with affidavit but if a case of 2007 is running in court still today which is not supported by affidavit then can we demand court for complainant affidavit ???

Complaint pending since 2007 in the court, the evidence of the complainant must have been recorded and must be on court record, so what for affidavit of the complainant now required?

yes her evidences has been recorded but there are very false things in her complaint petition which can be proved now when I got so many documents via Rti so now I want to put crpc 340 application against her false but for this it is necessary that her petition should be attached with affidavit so for that purpose can I pray court ? my defense stage has come now in matter

Not necessary for application u/s 340 Cr.P.C to have her affidavit on record, her statement on oath is which can be challenged by you for offence of perjury. Attach the evidence you got through RTI, with application u/s 340 Cr.P.C about her committing perjury in the court proceedings.

Seems to be quite a vague query.
However, is the case against you and what is the nature of private complaint and why you could not ask your question from your own lawyer, who may be fighting your case for the last 11 years?

but sir there is a very much powerful fact available in her petition (without affidavit) which I can prove now false but unfortunately it was not discussed during her cross by my lawyer so I am afraid that they can say that they are responsible only for their witness statement in court and they are free from responsibility of petition which was presented without any affidavit

Generally in the first stage of such family disfuit cases lawyers don't take these things seriously and they leave many reasonable things thinking that soon a embicable settlement will come and case will close and that's why we accused have to change the lawyers and have to beg here and there
