Hello sir ,
I married to a guy in 2013 .Within four months I faced domestic violence, dowry abuses and threats from my husband to terminate the marriage which lead to suicidal circumstances for me. At the same time I got to know about the extra-marital affairs of him. Now its been four years, he is under trial for the offences. Now I got to know that he is living with a girl in his home and they had a baby boy as well. My question is Can I file a case of bigamy against him? As he has a baby and he is living with that girl in the same house with his family.

You can file criminal complaint for bigamy under section 494 IPC only if you have sufficient evidence of solemnisation of both marriages the husband has gone through. You can always produce in the court proof of your marriage solemnisation with the help of photographs, video and witnesses of the essential marriage ceremonies which make your marriage valid in the eye of law. However if that evidence you are not having for the second marriage of your husband than simply because he lives with another woman and has fathered a child from the woman will not be sufficient to hold him guilty of bigamy under section 494 IPC.

yes, you can place criminal proceeding against your husband for the offenses, as stated by you, before the competent criminal court of law of your jurisdiction.

Hazy description. Extra marital affair and bigamy are two distinct things. Do you have any proof of his 2nd marriage?

You have not filed the complaint which you could (atleast what is appearing form given facts) in the thana and you now want to file "PIL"
