DTH Removal Notice from Coperative HSG Society

Hi,
I am Staying in Dombiwali. Developer initially framed a rule about not installing DTH in the flat. After forming society it continued with this rule. There is only one cable operator available in the entire township. When I shifted in the flat Itried contacted the cable operator many times but there was no response from him so finally I installed DTH in my balcony. Now society sent me notice to remove the dth in 15 days and opt for the cable service. I don�t want to go for cable service. Do I have any option to keep DTH ? If yes how can I do it? Along with me there are 8 members in entire society where 8 wings are there installed DTH. Society sent notice to all of them. Kindly suggest what options I have.

The Society is overreaching. They cannot insist on removal of DTH so long as it does not cause inconvenience to anyone or the Society sa such.

The verbal rule developed by developer may not necessary be Bye Law or constitution…

Challenge the order of Society, it is illegal.
Consult a local prudent lawyer and seek his/her professional service to obtain necessary mandate from Civil Judge or High Court.

Even for challenging the order you have to refer to the Constitution of the Society.

IRRESPECTIVE OF THE SOCIETY BYE-LAWS /CONSTITUTION:
1. Serve a proper Legal Notice to the Society, questioning their jurisdiction to direct you to choose a particular Cable operator, against your wishes.

2. Serve another Legal Notice to the Society, questioning their jurisdiction to direct you to remove your DTH connection, and forcing you to follow their preferred contractor.

3. File Criminal Complaint against the Society's signatory of the Notice, with the local Police Station, for Criminal Threat /Intimidation and Harassment.

4. IF things get murkier, FILE grievance petition before the local Consumer Court, against the Society's harassment, deficiency and negligence AND consequently claim damages /compensation. This will set right the nefarious attitude of the Society, PERMANENTLY.
