Filing an fir for a road accident

(Querist) 16 November 2017 This query is : Resolved
I have been in a road accident recently and got hurt. Some people are telling me to file an FIR but i dont want to go through the trouble of going to court and all. Can anyone explain me what happens "IN REALITY" after an FIR is lodged. And when does it reach to court for very minor damage.

The fault if proved of the vehicle driver, he may be punished.

You can file claim of damages.

If only a small damage has happened still you can prosecute both the owner and the vehicle driver and 3rd party Insurer for compensation for the damage or injuries inflicted. They may pay reasonable compensation.

What if i cant prove that they are at fault because i didint have any witness that could prove me correct. And moreover if i file an FIR and cant be present at the court will the charges be against me?

Your Lawyer through cross examination of the opposite party would elicit the truth.

If the damage is minor and there is no requirement of filing FIR, do not press for it.

I found the post as an academic without any substance.
Consult a local lawyer if there is some truth in the story.
