Dear Sir/Madam
Pls let me guide to figth CRPC 125 file by wife even after available below facts.
1. Post mediation held at dist court and as per deed terms both party husband and wife withdrawn their cases after learnt by the ADJ and started leaving to gather and thereafter separated again within 2 months and wife again file CRPC 125 after 1 year from date of separation.
2. Wife is well educated capable for working as she is MSc, BSE, BED and was working before the marriage and now days may be working.
3. A FIR also was lodged bcs she was already divorced but concealed at the time of marriage as marriage which were took place through famous matrimony web site, secondly charge sheet of the same was not proceed bcs cases were withdrawn as per mediation held at Dist court.

The fresh case of section 125 Cr.P.C is filed by the separated wife for her maintenance. Even though she is well qualified and had been working before marriage, but the recent situation of her not doing any job nor having sufficient means to maintain herself entitle her for monthly maintenance under this provision of law. The wife moved out of the matrimonial home and refuse to live with husband without any reasonable ground will disentitle her the maintenance relief if husband is ready to keep her with him and provide her maintenance.
You if are not interested to keep her back can file for divorce on the basis of the agreement done between both as her moving out of the matrimonial home is act of cruelty and filing fresh case against you after all was settled between both.

Thanks for your reply....for your information as per terms of deed held at Mediation center dist court in relative case of nullity of marriage after learn by the ADJ that the both parties will withdrawn there cases and not go any litigation in future and thereafter both parties withdrawn accordingly and started leave to gathered for next 2 month only and thereafter more than year she file fresh case, pls suggest.
