Ownership Rights

(Querist) 25 October 2017 This query is : Resolved
Hi Everyone,
My grandfather had one flat in chawl. After my grand father, my father and uncle used to stay in that flat for many years. In 1990, my father has shifted to virar without taking share from my uncle. Till that day the property was on my grandfather's name. Afterwards that chawl get redeveloped and my uncle get one flat in that building. On building name plate My uncle have his name as a owner. Is this possible without my father consent, the ownership transferred to my uncle? Can we claim our share from this property legally? Now my Father and uncle get expired last year.

It is understood that the premises were rental, in which case any property rights do not exist. You should have taken a stand, with a proof of residence, at the time of the redevelopment.

WHILE "NOT" AGREEING WITH ADVISE OF SHRI KISHOR MEHTA
1. "IF" the "Title-Ownership" of the Chawl-Flat, was in name of Grand-Father, THEN your Father & Uncle (being the residual legal heirs) have equal Title-Ownership rights over the Flat, without any exceptions, under the parameters of Hindu Succession Act.

2. File Criminal case and Civil Suit against Uncle and Builder (of redevelopment project), for Misrepresentation & Cheating your father (or you), of the 50% Title-Ownership rights of the Grandfathers property.

Keep Smiling .... Hemant Agarwal
