Property registration

I have a property on only my name. I wanted to sell my property to a purchaser. But the purchaser wrongly (not according to our contract) prepared the agreement paper and payed stamp dutybon that. But I do not want to go further with this deal with that purchaser any more.
NOW AM I LEGALLY BOUND TO PAY HIM A CERTAIN PROPORTION OF MONEY FOR HIS EXPENSES REGARDING HIS PREPARATION OF STAMP DUTY AND DOCUMENTS EVEN IF HE REFUND STAMP DUTY?(BEACUSE 10% WILL BE DEDUCTED FROM STAMP DUTY WHILE REFUNDING)

For legal advice, agreement to sell has to be referred.

He can prefer for specific performance.

amicable settlement would be better option.

Since there is a breach of original contract by the seller you can rescind the contract and file a civil suit for damages against the seller as per your wish. You've done a right thing by rescinding the contract from your end the moment it is breached by the seller which you did so by withholding payment of purchase money and registration of sale Deed.

The issue could be much more if he files a suit for specific performance. Everyone is bound to keep their promises.

You have refused to sign due to draft of sale deed being not according to T&C of agreement to sell.


Hope you have a copy of both.

Hope you have the evidence that you appeared on agreed date to register sale deed and declined due to variance duly pointed out by you.

Still if possible, settle amicably.
