Release deed

(Querist) 31 August 2017 This query is : Resolved
What is the stamp duty have to be paid for release deed
Ms.Usha Kapoor (Expert) 01 September 2017
If the Deed of Release is in favor of family member2. Release among family members — Article 45(b) of the Karnataka Stamp Act, 1957.

At present, release of immovable property at a concessional stamp duty of Rs.1,000 can be made by any person to his/her family members which includes husband, wife, son, father, mother, brother, sister, wife of predeceased son and children of predeceased son or predeceased daughter.

The budget has proposed the inclusion of wife/children of predeceased brother, husband/children of predeceased sister in the definition of family members which effectively means that on and from April 1, a release deed executed in favour of the aforesaid persons will also get the benefit of a concessional stamp duty of Rs.1,000 only.

Schedule1 of article 55 of Indian Stamp Act deals with payment of stamp duty in respect of release or relinquishment deed. Check with the registration Department.
