ST/SC land

Hai attorney

My grandfather brought a government agricultural land from ST's directly before 30 years ago.At that time he didn't registered that property.But he took the registered papers from them and took the signatures of those people on new stamp papers.During the division of properties that property divided into four halfs and my father got 1/4th of the property but my father gave money to my uncles and he bought that remaining 3/4th land.My father took the signatures of my uncles on new stamp papers.Upto now that whole is not registered on my father name.But my father have the original papers of that land and signatures of those people(on whose names the land is there).So, can any one please tell me the solution how to register that land on my fathers name.

The transactions, as stated, involve conveyance property. And it is of no probative value as they have not been duly registered.

1. FIRSTLY, "agricultural land" allotted to SC/ST persons, CANNOT be Sold /Purchased, by anybody, UNTIL proper documentary procedures are conducted at the local Collectors office.

2. SECONDLY, no property can be transferred to "Anonymous", irrespective of any criteria.

It is not the case that your grandfather did not register the property. Nobody is foolish enough to pay the money without signing of registry in tehsil office.

The case is that he could not at all get it registered. He just paid the money and disposed the Tribal from custody of land and they did not agitate. Such sale is illegal and cannot be registered.

Title of land is passed only by registration.

You are liable to retunr the land and the tribal are not liable to return money.

Agree with Mr.Hemant Agarwal.more over any unregistered document would be legally invalid now.Better show all the documents with up to date EC for 30 years and seek the guidance of local good senior civil side advocate
