My residential plot converted to road without notifications by rajasthan govt

My residential plot in a private layout purchased in 1994 has been converted into road in 2013 by Jodhpur Development Authority-Jodhpur (Rajasthan Govt), WITHOUT ANY NOTIFICATIONS and are not responding to my appeals and have neither refuted to my RTI claims nor have furnished copy of notification asked for.

Am I entitled to alternative plot and/or monetary compensation if the plot cannot be restored to me.

How to approach this matter for remedial recourse

You can file a writ in H C after giving representation to the concerned authorities

No land is acquired without issue of due notification well in advance. Also due compensation is allowed to the land owners by the revenue authorities.

Gazette Notification is always issued and published through local and national level newspapers to call for objections of the land owners about proposed acquisition of land required for any use or disposal by the State Government. That notice must have not been overlooked by you

So, any blind folded legal action may not help you in any way and can prove sheer wastage of your time and money if you try without verification from the local DM or the concerned State authorities, as the case may be.

In India officers do not act as per law. In spite tri query no information furnished means they have illegally converted plot into road. So only course get relief is writ in high court.

Assumption based misconceptions have no remedy. Better check the position at first from the DM office before initiation of any court case.

Such development Authorities have EO ( Estate Officer) and are covered by RTI.


Meet EO and explain your grievance and submit in writing under proper acknowledgment..



Such Authority are under Dept. of Local Government.


Go thru details under RTI provided by Authority and write above PIO.

Thank you all, sirs, for replies,comments & suggestions.
None of the state govt officials have refuted my claims nor have so far replied to my representations.
Even after sufficient time lapse I've received NO response to my RTI (about ten of them) seeking details/copies of notifications. RTI applications have been made to JDA-Jodhpur, Divnl Commissioner, Dist Collector cum DM.
Only one officials, that is the respective zonal commissioner phoned me to inform that due to some error this plot was acquisition-ed.

May be after some more waiting,can any other alternate legit means be suggested please.

Approximately how long it takes for matter to be resolved if writ is filed in high court (once I prove with documentary evidence that the local govt authority has gravely erred).

I am a Sr citizen & a heart patient undergoing treatment at B'lore, therefore in light of this will the COURT view my case expeditiously if established to be genuine: about both my health & about illegality by local govt?

Being a land acquisition case, your case would lie in the DM's court, not in HC.

The Authorities (JDA-Jodhpur) have not been able to issue/produce copies of notifications.
(copies of Gazette Notification, publications through local and national level newspapers to call for objections of the land owners about proposed acquisition of land by State Government)
I have made several representation to the concerned authorities directly and thru RTI and there has been no information furnished.
Even for the RTI made to DM which in turn has been for the concerned State authorities, as the case may be.
forwarded to JDA, there has been no response.
What is the next recourse available to me, Please suggest.

Better meet personally to the DM to seek any clarification, before you go for litigation.
