Execution of will

(Querist) 15 May 2017 This query is : Resolved
My grandma made a will but before registration she passed away and my father's elder brother filled a case challenging it can we execute the will any legal stand for it
Rajendra K Goyal (Expert) 15 May 2017
Registration of will is not mandatory.

If the will contains required witness and can be proved that it was executed without force, coercion, in mentally fit conditions, your fathers elder brother may not succeed.

“my father's elder brother filled a case challenging it”

The WILL has been challenged.

If the WILL is valid and proved without any cloud on it, court shall decide in your favor.
Kumar Doab (Expert) 15 May 2017
Approach a very able and senior counsel of unshakable repute and integrity at your location specializing in such/succession/civil matters to defend you.
Adv. Yogen Kakade (Expert) 16 May 2017
As the will has already been challenged in the court, all you need is to get a good lawyer to keep your part strongly before the court, as a will cannot be proved illegal merely on the grounds of non registration.
Kumar Doab (Expert) 16 May 2017
It is not mandatory to register the WILL.
