MY UNCLE (FATHER'S REAL BROTHER) HAS EXPIRED IN 2009. HE WAS UNMARRIED AND HAD NO FAMILY EXCEPT HIS BROTHER AND THEIR CHILDREN . HE HAS IMMOVABLE PROPERTY. WHO IS THE LEGAL HEIR?
AS MY FATHER HAS RENOUNCE THE WORLD AND BECAME SADHU 14-15 YEARS AGO. MY UNCLE HAS LEFT NO WILL . THE ONLY THING ONCE HE NOMINATED MY FATHER ON HIS PF book. HE HAS NO NOMINEE NAME IN BANK ACCOUNTS. WE ARE ONLY THREE SISTERS AND MY MOTHER. WE HAVE NOT MADE ANY FIR FOR OUR FATHER . WHO HAS A BETTER RIGHT OF SUCCESSION; MY FAHTER OR US.AS WE HAVE NO WAREABOUTS OF OUR FATHER.HOW SHOULD WE PROCEED? HOW MUCH TIME IT TAKE TO GET THE SUCCESSION CERTIFICATE.

You need to apply to the court of the proper jurisdiction to succeed your Uncle's properties. It is best to contact a local advocate who can guide you properly in the matter after personally speaking to you.

In the long long absence of your father, you all are the next beneficiary of the properties left by your chacha ji so apply for the succession certificate from the court and also do not miss to mention the name of your father as one of the respondents in that petition and after deciding petition ex-parte court shall provide you succession certificate. No one can tell exact time to be incurred in the courts.
