Release of original title deeds by bank

I am a Ex Bank employee dismissed in 2011 due to duplicate Patta Passbook. I have now closed my Housing Loan a/c. in Dec.2016 and requested for release of original title deeds. Though it is more than a month the bank is delaying the release of Original Title Deeds. CBI case is at trial stage and it may take another 2 years.
Please guide me for the release of title deeds, whether I can proceed Legally. If so in what way ? Even so far I have not been given my SPF savings also nor any benefits after dismissal.

First Send an Official Request Letter to return the documents explaining in detail and in that letter you need not refer about CBI matters.Send that letter by Registered /Speed Post with ack due and wait for their reply (for 30 days from the date of receipt of letter by the Bank) and then we could proceed.You could also send necessary postage stamps to return the documents.

You can submit under proper acknowledgment t supply you the original title deed.


Hope you the authenticated copies of loan application, agreement, loan statement, NOC!

Proceed as advised by the expert Kumar Doab.

If the Bank is PSU use RTI to know the reason of not releasing your title deeds and proceed as circumstances warrant.

You can proceed legally. When housing loan is already closed the bank has no right to withhold your original title deed. Case os non-payment of SPF, etc. has a separate entity. That has no concern with your housing loan. You may take up separately for each issue, not collectively.

Your case is under trial. I think if the bank knows about your case, the bank may not release the documents.

I would like to differ with the opinion of Shri kavksatyanarayana, as the court case for the offense in discharge of official duties has no relation with the home loan and the release of title deed on closure of the housing loan by the employee.

I also share above view of Mr Dhingra.

Bank may be justified in withholding the terminal dues. However in matter of housing loan then are no more interested to hold title deed.

If the bank does not reply pursue the RTI route as suggested by Mr. Rajendra K Goyal.
