summoning of witness in defence

in a crl case accused has move an application for calling a witness in his defence on govt expenses as the case is state case not pvt complaint but magistrate has given him direction to deposit expenses of witness first,kindly advice what i have to say to court.Vinod (Haryana)

Bansal ji! If the accused is behind jail only then he is entitled for the summoned witness at the Govt. expenses otherwise he has to pay what ever is fixed by court as DM/TA/DA of the summoned witness even in criminal case.

If the accuses is in custody then he is entitled for the summoned witness at the Govt. expenses, as you said magistrate has not given any direction to deposit expences then there is no need to deposite.
