(Querist) 13 April 2016 This query is : Resolved
What is the difference between list of documents attached along with petition and documentary evidence submitted during evidence? Does these list of documents submitted along with petition gets marked as exhibits ? This is for maintenance case in crpc 125
ROHIT SHARMA (Expert) 13 April 2016
1. The documents listed in the List of Documents need to be produced in original and have them admitted by the other party while during his/her cross examination. The documents mentioned in the List of Documents are called 'mark - No. " and when the same are shown to the court or to the witnesses during the trial then these listed documents are marked as :Exhibits" by the court.

list of document is a printed form on which the number and description of documents filed with petition is written.documentary evidence is the original documents filed in court file which are exhibited during evidence.

The documents annexed with the petition would not be exhibited during evidence until and unless the complainant formally proves it in court as per the EVIDENCE ACT.
