Dear Expertise
My sister lost her husband in Februay 2016 in an accident While he was on leave and traveling
Her husband worked in a private company and contributed his and employers share towards PF and EPS.
His served in the company for 8 years
He has wife and two children one 4 years and other 8 years
His last basic is Rs.7900/-
Now queries as follows
1.Can she claim full Provident Fund standing credit in the account
2.Can she claim full Pension Fund standing credit in the account
3.Is the widow and children pension benefit given by the PF office is apart from the PF and pension Fund standing credit or PF office will give only from the pension fund balance
4.What is the ELDI amount she will get.
5.Is her existing personal SB account is sufficient to receive the PF and Pension fund or is it mandatory to open SB accounts of all the three family members separately (wife and two children)for pension.

The employer must have recorded the nomination in PF and nominee is usually spouse.
If she is the nominee she can claim.
The PF a/c if it is 10Y old then pension can be started...............or the pension component in pension fund shall be paid.
The employer shall help to submit the forms. She may keep the copies.
She may also claim Gratuity, personal accident claim policy fund, group accident (if T&C allow in instant case), ATM/Debit card accident claim, Bank a/c ( if it provides such claim), Life Insurance, mediclaim, Credit card ( if it provides such claim)........
The funds are paid in bank a/c.....

it is better you may visit PF office and meet PRO. If not satisfied then the APFC/RPFC

She should proceed for compensation if accident was from some vehicle.

My sister's husband was travelling in his brother in laws car who was driving. He hit the standing tanker out of control. From whom should she claim.

Discuss with local lawyer, show him case file and explore the scope whether compensation case can be filed against the insurance company which insured the tanker.

Car is insured. But deceased is not the owner of the car. infact it is his brother in law's who was driving.
