marriage validity

A few years back I was blackmailed into marrying a girl with whom I had a casual affair in a secret ceremony ,thereafter i did not cohabit with her even a single day and left for another place on some pretex after a few years I legally married in presence of family and have children,now the girl comes back and claims to be my wife and threatening to put a case against me,how can i prove that my first marriage is not valid...

If she has no photographs and other evidence with her then it is better to deny performing any marriage with her otherwise you would have first got nullified your first marriage from the competent court of law as the same had never been consumated and only after passing a decree, you would have performed your second marriage.

In the light of law narrated by me, you decide what line you want to adopt.

depends on what evidance she have ? if she can prove that marriage you should go to divorce . but you can challenge that merriage

prior to u she has to proove that she had legally married you , the burden of proof will lies on her only, but not on you, if she succeds strongly , then u have to proove that it is not a legal one

i agree with Mr. Makkad and Mr. Srinath

if she is able to prove marriage only then u ll be in trouble.

blackmailing aspect my not stand in your favour....as you could have protested it immediately.

but the initial burden is upon her.
