Validity of sale agreement

(Querist) 13 December 2015 This query is : Resolved
Sir, If sale deed is executed, Then Still sale agreement holds validity? Is vendor or purchaser can be sued according to terms and conditions mentioned in Sale agreement? (and same terms and conditions are not mentioned in Sale deed)
Devajyoti Barman (Expert) 13 December 2015
With the execution , registration and implementation of sale deed the sale agreement goes.
So no cause of action arises on the terms of the sale agreement if sale deed is executed and registered.

There is no value to the sale agreement after execution and registration of sale deed.
Advocate. Arunagiri (Expert) 17 December 2015
As long as the property was not sold to a third party, the agreement holder can file a suit for specific performance.

Once the property is sold to a third party, the agreement holder can sue for compensation. He can also prefer a police complaint for cheating.

Thank you Srinivas sir and Arunagiri sir

Instead of asking a blunt question, you cold have discussed your problems so that more proper opinions could have been rendered by experts here.
Actually if the sale deed was not executed to the buyer who had entered into sale agreement with the vendor, then that buyer has a case to enforce his sale agreement despite this property was alienated by a sale deed to a third party.
