Regarding dv act

Sir I have filed suit under DV Act 2 years ago.. Maintenance order has been passed by the court 1 year ago (mean on last December 2014).Recently we have filed Affidavit and other original documents which shows that the Domestic Violence had occurred.May on next to next date there will be Cross questioning by the both lawyers.
1)My question is my husband has deposited only Rs.2000 which is 500 more than one month maintenance(Total Maintenance amount is Rs.30000),So he or his lawyer is entitle to cross me as they have paid only a nominal amount??
2)If i would like to withdraw the case before final judgement,then shall he be compelled by the court to pay the entire maintenance amount ? or he can pay or deposit according to his desire? Please provide some guidance .Thank you in advance.

Hi ,
As far as , right of cross-examination is concerned , each party/pleader has right to cross , irrespective of the amount paid in accordance or not .
Secondly, get the order of interim maintenance executed by way of attachment of his ( husband's ) property or get him arrest for not obeying the order of the court .
Withdrawal is not conducive option at this stage .

Yes his lawyer or he is entitled to cross.

Proceed to recover the balance maintenance through court.

About withdrawal, in view of the given facts it is not recommended.

his lawyer is entitle to cross examine but if you want to withdraw your case then it will be better to settle the matter amicably with him through mediation.

otherwise fight the case.

1. Payment of nominal amount is not a bar for cross-examination.

2. Prey the court of total implementation of the order for maintenance.

3. He can not deposit according to his desire. He should abide by the court order.
