Dear sir,

As in regard to my client,he has dispute with his wife.he is a victim of 498a and 406 respectively.he got A.B from Delhi high court as he has given all gold items to his wife at ssp office in front of ssp junior and his junior has given a statement that gold has been given by my client to his wife in front of him.now my client's wife has filled a slp before supreme court challenging the A.B and non return of gold items.the parties are wife v/s state and my client.

my query is that what can be done as he has given the gold items to his wife.please guide me more

when golden ornaments are given before the police officer there might be some documents. If ur client has such document then produce before the court, otherwise it will be a problem.

in regard to above query which is answered by ld rajeev g it is a fcat that when my client's parents approched to court of sessions then the session court marked a enqury to concerened ssp office then the officer of that ssp has given a written statement to the court that the gild was given and bail granted to my client's wife now pl tell some more guidence

If statement has been made by SSP office before the court of Sessions Judge to the effect that the ornaments have already been handed over to your wife then nothing to worry. Even if your wife has approached SC and has not challenged the veracity of the statement made before Sessions Judge as per procedure, she has got no legal right to approach directly before SC without availing other modes given under law. You keep on insisting the same version and obtain the certified copy of the statement of the witness from the office of SSP.

Had your wife signed/acknowledged the receipt of her ornaments in the office of SSP?

If yes, obtain its certified cpy also.

it is the basically the unsolveable dispute between the parties more so the statement before the court is enough to this effect that the jewellary items has been handed over to the complainant more so it is not a court of recovery for these things let him prove the same the anticipatory granted on this assertion that the gold items has been returned the supreme court will not interfere generally in these circumstances unless some other grave circumstance compel the court to interfere other wise it is very difficult to cancel the bail enlarged to the petitioner but not impossible.
