Parental Maintenance Act 2007

Querist : Anonymous (Querist) 29 December 2009 This query is : Resolved
As per parental maintenance act 2007,if parents transfer their property to one of their children who subsequently fails to support them, then this transfer of property gets cancelled or reversed when parents sue the beneficiary offspring for maintenance under the new act mentioned above. What happens when one of the offspring buys parent's property from parent at market rate?Whether such sale-purchase between a son and widowed mother gets cancelled automatically if mother subsequently asks for maintenance from this very son who had purchased her property from her?
Adv Archana Deshmukh (Expert) 29 December 2009
Absolutely not. maintenance and property transaction are totally different issues. The property sale will remain as it is. If the parent is unable to maintain himself / herself then he / she can seek maintainance from the children thats all.
