Paternity leave

Dear Experts,

What is the maximum number of days leave can be taken under Paternity Leave in a Pvt Ltd co.

Is there any time limit to avail the leave?

Kindly clarify.

We have a concept of maternity leave.
there is no law for grant of paternity leave in indian labour laws.

Depends on the company rules, if they have scheme / system of for such leaves.

Paternity Leave does exist in Govt and private establishments.


However in case of a private company Shall be governed by the enactments/rules that govern the service conditions of employees working in establishment e.g;


If the establishment is Shop/Commercial: Shops & Establishments Act



If the establishment is Industrial: Factory Act





Any establishment can offer superior benefits as per negotiated settlement with employees, standing orders but not inferior.



If Paternity leave is made part of leave policy/rules then normally it is not to be refused.

However you may go thru the language pertaining to Paternity leave in leave policy.
