Wages of contract employees has not been paid for last 5 month

sir there are many contract workder who are working as peons, orderly, sweepers in hospital who are employed through contracter has the greiavnces that they have not been piad salary for last 5 months..They have approached to the labour commissioner office and where the verison of the hospital was heard .The hospital authroities has informed that the contracter whereabouts are not known to them as he run awy and left the security depsoit in the hsopital and the employee will get the salary as they have moved the file to the secreatrait and only after getting the orders..The question is how long the employees have to wait for the wages for the work which they have done? Is there any instant relief for getting their salary/wages for the work they have performed?

file a criminal complaint against the contractor and stop doing work.

the employees may first send a legal notice to contractor and if the contractor is not ready to pay then file a civil suit for recovery against him before court and the workers may file a complaint before labour court too.

The hospital adminsitration has now been deploying new staff through other contractor? what will be the remedy if new contractor deployes new workers there the fate and livilhood of the existing workers will be affected

Let the labour commissioner decide the dispute as the case is pending therein.
In the meantime hospital can not be restrained to engage new staffs.

The contract employees should approach the Human Rights Commission. The Government and the Hospital authorities have a strict obligation to pay the wages for the work and safeguard their Right to Life.

Principle employer is liable to pay.
The workers can lodge complaint with:
Inspector under Payment of Wages Act, too.
The workers’ may approach trade unions, media and agitate…………….and this can fetch them speedy relief.
