About loan please do answer

Hi all,

My husband gave about 8-10 lakhs money to his friends as loan, they used to pay interest of 2% every month. 2 weeks back he met with accident he is no more. I saw few cheques( some blank cheque and some with the amount they took) now only one of his friend came and gave me the amount which he has to pay and the others made excuses like they made the settlement long back and only few thousands they have to pay
So please let me know what legal action should I take

if you have blank cheque or filled cheque yo u deposit, if its bounce, then immediately made legal notice after file a NI138 case, i hope that they will come once get legal notice, where are you from ?

YOUR ONLY BEST OPTION IS TO GET A SUCCESSION CERTIFICATE ABOUT DEBTS DUE ON BASIS OF THOSE UNPAID CHEQUES AND TO FILE A SMALL CAUSES CIVIL SUIT OF REALIZATION IN COURT.

was loan advanced based on any agreement ? whether given by cash or cheque ? what is the amount due and payable by his friends? has your husband declared this loan in his itax returns ? contact a local lawyer

You have to find out the names and amounts paid to each one, particulars of repayments, etc., to proceed legally. You may go through his bank pass books to get some idea of payments and receipts. Without any evidence it would be difficult to proceed legally. Any elders of the family or a respectable person of the locality, can arrrange a meeting of such persons to obtain some information, before proceeding further.

In your present situation, it is advised to contact a local lawyer immediately with all papers/ documents.

Without knowing proper details of the amount lent, to whom, when etc., you may not be able to sue any of the borrower, hence ascertain details, contact a local lawyer and initiate legal steps for recovery accordingly.
