sir,
i have taken a personal loan of rs65000 from canara bank in delhi through my previous employer in 2005.I was jobless and shifted to my native in odisha. from then i have not payed the emi.i was defaultersince 9 yrs. the bank never send me letters nor contacted me.during taking the loan i have not given PAN NO also.inbetween i have lost my loan a/c no. also.now in present compny i have taken one personal loan.please give me suggesion what to do.wheather i will pay the loan amount which may be 5/6 times more or wait for the bank to issue me letters.i have one relative in canarabank in high level but i hav not told anything to him.

Since you have borrowed money, you ara liable to make payment.

You may contact the bank and go in for one time settlement as the loan could have been classified as non-performing asset.

The Bank loan is time barred.

Check whether the loan default is shown in your CIBIL report.

If you want to settle the loan account may contact the Bank.

However, the Bank must have written off the amount in order to clean its Balance sheet.

1.No. While providing loan, Banks take blank undated signed document named acknowledgement of debt to overcome this limitation problem,

2. There is a loan in your name which is multiplying with added interest on it,

3. Bank may refer the matter to police declaring you as absconder or fraud & in such case police will search you out,

4. Why taking such risk when you are now working,

5. In such cases of Bad Loans, Banks waive interest generously,

6. Your account has become NPA long back and Bank can settle your loan if you just pay the ledger balance only,

7. Visit the Bank for negotiating for one time settlement giving a letter from some Delhi address,

8. If Bank agrees, settle the loan by paying the ledger balance and get rid of the future problem, if any.

Legal advise is that you have to pay back the loan amount you have availed. you may follow the suggestions made by expert Mr. Ganguly.

Sir,
as per ur advice i had contacted the branch,they ask me how much i can pay and give on writing.i email them the amount which i can pay.but alredy 2 months gone they are not giving me settlement letter after receiving i can pay the amount.every week i called the settlement manager but they are telling we send the letter to head office when reply came we will contact u.
please tell whether any legal advisor in delhi can help in this matter.if so give the details sothat i can contact him
