Eviction of lease property

Dear sir,

I am Ajay Kumar Reddy, I have purchased one house by lease. My lease property is not registered due to some administraion reason. But unfortunatally my ex wife is unautorized captured my property. so for eviction of my ex wife from my house there is any other rules and regulation. Please clarify me under right to transfer of property. she has captured before divorse. So can i go for the tresspass.

Ask your landlord to initiate eviction procedure against your wife, You stop paying rent as well.

you are mere lessee of the property. if you stop paying rentals lessor will take eviction proceedings .

if it is for monthly premium, better not to pay. If it is for lumpsum, you better to have go for a settlement with your Ex-wife

Respected all Exper sir,

Thank you very much who has given me the answer in my querry. But my condition is entirly different, I have purchased that leased house from my comapny Bhilai Steel Plant (SAIL). I have taken the loan from ICICI bank and given the whole amount as per the rate fixed by my company. So now i am giving EMI for that loan. I can't stop to payment of EMI because I am Public sector emloyee. As per lease agreement Electricity bill, Water bill and annual lease amount deduct from my salay.
she has captured before divorse.Now Please clarify me under right to transfer of property of lease section. how to evict?
She has made large scale construction, so can i go for the tresspass?

Dear Mr. Ajay Kumar Reddy,

1. Since she has occupied the house after divorce and you have had paid her alimony then she has no legal right to occupy such house and since she has made large scale construction, so you can file a criminal complaint against her for trespassing and occupying your house in your absence.

Did you purchase or have taken lease of the property?, What do you mean by purchased the leased property? Is it a leasehold property? Whatever it is, your ex-wife has trespassed into your house especially in the event of the conditions of divorce have been fulfilled duly. An action by due process of law will be the next option before you to evict her, never man handle her, that will become another offence against you.

Hi Expert sir,

It is leased property which sold by my company Bhilai Steel Plant (SAIL). my ex wife residing in my house b4 divorce after broken of my lock in my house. At tat time i have given complaint to the Police also. So at that time police has said me that she is your's wife so she can reside there. It is the actual senoirio. In F/c she has given one application for last alimony in divorce case but Judge has not gvn any order on that application. She has appealed in HC but in that application she has not mentioned about last alimony and she has not written any line that Judge has not given any order on last alimony application. But after divorce of 2.6 yr she has given 1 application for last aliony but from last 1.6 yr court is vaccant so that application is not solved and she has not given any transfer application sica last 1.6yrs.
She is working as loecturer in collage that leased house purcahsed by my money and i am paying EMI from 2002, Lease amount, electricity bill and water bill also. so now please suggest me how i can evict my house?
