Section 66a IT Act

Respected Experts, recently an order was passed ''no arrest before prior approval under section 66a''. My query is that whether complaint can be registered without approval or it will also need approval as said above ? Plz illuminate

Better discuss your problem, rather than making academic query. Further, a question arises, in which capacity you are concerned with the arrest with or without approval?

@ dhingra sir i objected to a some posts in facebook and they told to file FIR under 66a. So is it possible now?

Sir, he is some job aspirant keeps doing cases on govt. recruitment exams. He posted to again do some case and stay the exam. Then i and some others also objected to this and posted some threatening comments also for him. Then he said to file fir

Depends upon nature of objection, if that is actually violative of sec.66a. However, for filing any FIR, no permission from any authority is required irrespective of the result later on.

The provisions of the section of the act referred to above is thus:
Punishment for sending offensive messages through communication service, etc.

Any person who sends, by means of a computer resource or a communication device,

For the purpose of this section, terms “electronic mail” and “electronic mail message” means a message or information created or transmitted or received on a computer, computer system, computer resource or communication device including attachments in text, images, audio, video and any other electronic record, which may be transmitted with the message.

For making a complaint under this section no prior permission is required.
