Interim maintenance

i filed rcr one year back now my wife has asked for interim maintenance is it compulsary to give here interim maintenance can you please give and idea to tackle it. thank you

If your wife is not earning then you are bound to provide her maintenance.

If your wife is not earning, she can definitely claim maintenance amount from you.

If your wife is not working , you can be required by the court to pay interim even from date of application- For awarding maintenance from the date of application, express order is necessary- No special reasons, however, are required to be recorded by the Court.you can see the judgement cited on this issue 2008-3-Apex court judgement -page -129.

RCR and interim maintenance are two different issues which cannot be inter-linked.
She has a moral, social as well as legal right to be maintained by you, if she do not have any source of income.
Restitution of your conjugal right is decreed when you can prove that she does not stay with you.
