Full and final settlement

sir i worked in a pvt ltd company in last 9 years and 5 months. but company not take the pf.now i resigned my job. my salary is 40000.00/month and this is check payment.no salary slip.but company have 31 employees. no p.f. now i want to know about my settlement.
how much amount i have to claim. and how to calculate.please explain .

What is this establishment: Commercial, Industrial, Small Enterprise?
You are in which state?
Has the company issued any appointment letter to you?
Did you resign with immediate effect or submit notice of resignation?
If you have resigned by notice of resignation then you can submit FormI one month before effective date of resignation for payment of Gratuity.
Since your wages have been above Rs.6500/month you were included for PF.
Formulae for payment of Gratuity::::{( Basic+DA)/26*15*NO. of years of service}

Basic+DA as per last drawn salary. If NO break up and salary slip is issued you may claim whole amount as basic. Since in last year you have worked for<6M
You may count service as of 9Y.
If you have resigned with immediate effect company can adjust notice pay in FnF settlement.

Demand salary slip of all month’ of employment, service certificate, relieving letter, NOC/NDC,Form16…………….. FnF statement for verification and acceptance by you.

IN FnF Statement Company shall compute leave encashment, salary for day’s worked, reimbursements/incentives ………………….etc if any.
