Resignation

sir, i aem working in a gramin bank where one of my friend resigned to join allahabad bank po . he had complete his probation period but still he had to pay average of three month salary .where hrd department told him you should have to inform three month advance notice or pay three month salary. my question is is it fair ? how i predict three month advance. any why he has to pay three month salary ? please suggest what step he sould have to follow.

You may refer to the service rules and regulations that should be available on the website of the bank and also bank employee’s union’s website and relate with appointment letter issued to you.
If notice period is applicable as per service rules and regulation and option of notice pay in lieu of notice period is available then instead of resorting to verbal communications demand correct FnF statement for verification and acceptance and also acceptance of resignation, acknowledgment of handover of charge, NOC/NDC, service certificate, relieving letter, PF a/c slips etc…………….and tender payment of dues payable by you as per correct FnF statement and close the matter.
You may show all docs on record and give inputs to a labor consultant/service lawyer and proceed under expert advice of the lawyer. The lawyer that has examined all docs can advice you the best.

In few of the Gramin Bank there is no concept of notice pay etc. Please confirm in reference to your Gramin Bank.

If 3 months notice period is stipulated in the service regulations, your friend has to give 3 months notice to the present bank, after obtaining permission to join after 3 months in the new bank. for this no prediction is required. If it is not possible, he has to pay the equivalent amount of three months salary in lieu of notice period.

Your friend has to act according to the terms of his appointment. If he sees better career in the new job, he will have to pay three months' salary in lieu of 3 months notice period.
