Fraud in cash

Dear Sir,

someone has taken money with assurance for giving home under mhada housing scheme and we do not have any proof for money paid to them but we have recorded conversation of fraud person as they had taken money for mhada home. Also we have written covering letter with cheque bounced which they have given for repayment of our money. Kindly suggest me that can we get our money back as per mentioned evidence.

you have not stated how old is cheque bouncing issue and how old is cheque.

cheque date is 11th April 2014 and we deposited on the same day. when we came to know that cheque has been dishonoured after that we record the conversation of broker as he is liable to pay the cheque amount with in 15 days but still he is giving false promises. so My question is , that recording of conversation and bounce cheque is enough to file the case?

cheque is recently bounced and you are within time and you have not issued notice.

Give a notice and also a complaint with the local police narrating the entire details.

file an FIR under sec 17 of the contracts Act 1872 or file private complaint before relevant magistrate court, in case police refuse to take your FIR,
appoint an advocate to take further in the matter that nay solve your problem;

question is in MHADA cases of flat allotments there are no recognized agents at all but you tried illegal method. In fact you yourself committed the crime may also be a position.

Too late to file 138 ni;
Only remedy is lodge Police complaint. as u hv enough evidence that he cheated you, chq + recording will do.
