IF RETIRED PERSON WORKED MORE THAN 5 YEARS IN SAME COMPANY HE IS ELIGIBLE TO GETTING GRATUITY?
Guest (Expert) 08 February 2014
Academic query. Better state the real problem with age of the claimant, if retired from any organization other than the company, and the superannuation age prescribed by the company where he is employed after retirement.

Clarify again if he is associated with the same company and the is the relationship that of employer-Employee?
Dr J C Vashista (Expert) 09 February 2014
The query starts "RETIRED PERSON WORKED MORE THAN 5 YEARS" is obvious otherwise person do not get the status of RETIRED person.
Do you mean "re-employment" in the same company after retirement? Be clear and specific.
Gratuity is one of the element of terminal benefits, which is not paid again.
T. Kalaiselvan, Advocate (Expert) 10 February 2014
I agree with the opinion of Dr.Vashista on the subject issue. Once retired from the company with all the terminal benefits, and re-employed with the same company after retirement, there wont be a case for a repeat settlement of terminal benefits.
