Child care leave

Dear Sir,

My wife is regular teacher in Government school at Uttaranchal for last seven years. She has recently applied for Child Care Leaves for 20 days due to illness of 4 years old daughter (single child). The sanctioning authority has refused to sanction it citing reasons that there is orders from authority not to give CCL due to panchayati elections in March though he has no GO for the same.
My wife has asked the sanctioning authority to send the application back with reason for not sanctioning it.

Please suggest:
1. I want to make BO understand what is the meaning of a problem as he is a difficult person & exploit the situations. What are the steps which will help me to put BO in problem !!

2. Shall I put RTI asking for CCL sanctioned in Jan'14 & Feb'14 & send legal notice??

Please suggest the suitable way.

The Chief Minister of Uttarakhand, Ramesh Pokhriyal Nishank, on 9 March 2011 announced 2-year child care leave for women employees of the state government.
Sanction and refusal of CCL is a subjective discretionary matter of the sanctioning authority based on the genuineness of the Plea & administrative grounds.

CCL may not be granted for less than 15 days or in more than 3 spells.

The lady has already asked the sanctioning authority to send the application back with reason for not sanctioning it.

Try to explain the exigency by providing the sickness record of the child and the need for the mother to take care of the child.

In-spite of putting the BO in trouble please keep in mind how your work can be done. You can get it done by convincing the officer and if there is genuine problem try to adjust. The BO would face any adverse situation from your side with whole administration at his back and with the Government means while you have to proceed with your own. The matter can be settled amicably.
