Land in maharashtra

(Querist) 03 February 2014 This query is : Resolved
WE HAD PURCHASED A NON AGRICULTURE LAND IN 1998 IN THE NAME OF 4 FAMILY MEMBERS. THE 7/12 EXTRACTS ALSO HAVE OUR NAME. THE LAND IS SITUIATED NEAR KALYAN, MAHARASHTRA. ALL OF SUDDEN SOME LOCAL VILLAGERS STARTED CLAIMING THE LAND BELONGS TO THEM AS THE LAND WAS SOLD BY THEIR GRAND FATHERS TO US IN DRUNKEN STATE. THE VILLAGERS DOES NOT HAVE ANY PROOF IN PAPERS. TO SOLVE THIS MATTER PEACEFULLY WHAT WILL BE THE BEST SOLUTION.

If you have good title then ignore their claim,if any problem persist to your peaceful possession then file a Declaration and Injunction suit in local civil Court.

Obtain stay order against those persons and then make an amicable solution by offering some money to them and obtain their statements in the same case.

If your purchase and the sale deed is valid, you do not have to worry about such nuisance creators, and if they are going beyond some tolerable extent, yo can lodge a complaint with the police, it is they who have to file a suit for cancellation of your sale deed, you keep quiet until they are not coming with the legal action through court.

Thanks very much. Now we want to build the boundary walls. Forbwhich we started the work but same villager stopped the work by creating nuisance and are sending threats. The land falls under MMRDA town planing so do need to seek the permission to construct the boundary wall from local gram panchayat or MMRDA.

apply for permission before gram panchayat .if gram panchayat mentions that permission should be obtained from MMRDA then apply to MMRDA .

also lodge police complaints against the miscreants for criminal intimidation
ANKIT MALDR (Querist) 06 March 2015
We already lodged a police complaint. Police just called the villager and threatened him and told him not to repeat in future however I am quite sure he won't allow us to make the boundary walls and create nuisance again. How can I file a criminal case against the villager.
