CLAIM U/S 163 A

Hellow.
What ammount can be claimed under Motor Vehicle Act 1988.
My client was on bike and his father was driven said vehicle.
He sustained multiple injury due to dash of another vehicle, which came from back side in rash and negligent manner.
CRIME registered on driver of other vehicle.
Now problem is that he has no insurance of his vehicle then can I file claim petition U/S 163 A of M.V.ACT only against my father because our vehicle is insured with Package Policy.
If yes then can I claim total medical expanses or only 15000/-
