Power of attorney by multiple people

(Querist) 02 January 2014 This query is : Resolved
A, B, C, D and E are brothers and legal heirs of their father X who died intestate leaving behind a property.

Can A,C, D and E execute a single power of attorney in favour of B so that B can act on their behalf in respect of the property matters. Is it legally allowed.

A,C, D and E have no objection in giving such right to B since all 4 of them are unable to carry out the necessary formalities.

Dear Mr. Paresh,

It is not your understanding and my understanding of the Legal position in regard to such grant of a single power attorney by multiple persons. All will depend upon the person who has to recognise such an arrangement. If that fellow who has to recognise the POA does not understand and insist on separate POAs, you will have no remedy.

Therefore, it would be highly advisable from practicality point of view, to get individual power of attorney (instead of single power of attorney signed by multiple persons).

A thing which can be simplified should not be complicated by ourselves.

There is nothing wrong in all of the other brothers jointly executing a POA deed in favor of one single brother, it is valid and legal.
Advocate. Arunagiri (Expert) 11 January 2014
I go with Mr.Kalaiselvan.
