Rent of a shop

sir
my client have a shop in main market at kanpur on rent with pagdi given to the shop land lord.
now the land lord of the shop stop taking rent by my client.
and want that my client will leave the shop on behalf of pending rent amount(nearly approx the pagdi amount).

than my client approched to the court and paid amount in court.

but now the land lord and the land lady are closed the shop .
they are force fully taken the shop in their hand .
now my client is not avail opened the shop and have no money to pay the shop rent.

the shop has closed about from 2 yrs

1. what action my client have to take against his land lord.
2. the land lady afraiding my client by filing a false case under violence act.

3. my client is a single child of his parents . and not avail to fight with the land lord and his three sons.

1. Your client can take the possession back by way of court order and moreover a criminal case can also be got lodged against the landlord.

2. There is no base of threatening.

3. If he has not to fight then you help him or engage the person who has more than one children of his parents.

Since your client has not in a position to even pay the shop rent and since two years he has not been taking any action to re-open the shop etc., facts clearly establishes that your client is a "weak person" and hence now, how he is expecting to contest the case as against the landlord and land lady, who are powerful than your client and how your client could succeed to reopen the shop again. File a complaint against the Land lady.

Advise your client to take another premises so that his living is continued.

He should file criminal complaint against the land lord for forcibly taking the possession and get the possession vacated.

One should not fear the threatening, justice is there, it may take time.

Try lodging a police complaint under "social service category"
