Cidco 12.5% ges plot flat advise require

Dear sir,

i am intrested to pruchase a resales flat in Belapur Sec 14. the building is g+4 (4 flat only ) and standing on 12.5% GES plot.owner provided me following documents. kindly confirm it is adviseable to purchase such type of flat?
1. sale agreemnt ( between builder & 1st owner) 2. OC certifcate 3. Triparty agreement. 4. Land hership certificate 5. Cidco lease agreement.

the documents is view genuine but i have some doubt?

1.building Conveyance is pending 2. what will be the role of Builder or CIDCO for flat transfer 3. can CIDCO take any FEE for transfer of Flat ? 4. without Conveyance can CIDCO transfer this flat on my name ? 5. Bank will provide home loan to such flat ?

I would not advise to go with transaction.
It seems to be a serious matter and requires examination of all documents personally.
Hence better consult in person a nearby property lawyer with all documents.

CIDCo is owner of land and has goiven it on lease to builder who has constructed flats . since building has Occupation certificate it means building has been constructed as per building plans . read the terms of agreement between builder and owner . it would contain a clause as to resale of flats etc . many buildings in bombay dont have conveyance in favour of society . it appears in present case society has nnot been formed yet .

advisable to consult a local lawyer . you will have to pay trnasfer charges for trnasfer of flat in your name . .
