Property of great grandfather

(Querist) 06 December 2013 This query is : Resolved
We have an ancestral property (house) at my native place which is some 200 years old, passed from my great grandfather. We are from a Hindu family, the house was in my Grandmother's name (Paternal) till last year and my father changed to his name recently with the consent of her and her two daughters. The two daughters (my father's sisters) gave their consent then but now they are fighting for their rights on that house.Do they actually have legal rights on that property as per Hindu property law? Both of them are married, the elder one got married before 1980 and the younger one got married in 1989.

You have not mentioned the mode of the change of the ownership in his name by your father without which your question shall remain un-answered.

Please specify the document where your bua (father's sisters) has given their consent in favour of your father, which may or may not be revocable. Therefore, no advise can be given on such vague querry.

The details how the sisters of your father relinquished their rights, the contents of the documents need to be seen.
T. Kalaiselvan, Advocate (Expert) 07 December 2013
If the sisters and mother have relinquished their rights and executed a release deed in your father's favor, the same is valid once registered, until a condition thereon was not acted upon or not complied with by your father, the said deed is valid and sisters' claim can be negatived.
