After expiry of leave and License the Licensee does not vaca

(Querist) 19 October 2009 This query is : Resolved 
Leave and Licence Agreement was for 11 months. Amonth's notice was given to the Licensee, He has not vacated the premises and is trespassing for last 3 months. What action do you all recommend. I am not a lawyer.

Go to court file a suit for ejectment and claim damages get vacated the same its easy

U have arleady issued the notice, so u can file the suit for eviction. Contact ur local Advocate.

On expiry of licence agreement, the person become trespasser and therefore the problem would be of court fee. No doubt the civil suit is only the remedy.

Whether u have issued a notice u/s 106 of TP act or nor? if yes then file a suit for possession.

I agree with the views of others. Before filling Suit in the Civil Court Please verify that you have served proper notice as per aggrement and also as per provisions of Transfer of Property Act.

Pl suggest ways and means to speed up the process of eviction as my wife and I need to live in our own apartment without delay. I am 77 and my wife 65 and are now living in a relatives;s flat.
