I had been cheated by delhi based visa consultant i want to file a case against them and also the taken my money about rs.1.22lakhs.

if you have any documents or any agreed letters or correspondences then on such base you can file a criminal case. But sure to take his original and correct adress and general survey about that gai, before filing taking the criminal action aganist him, so that it will be helpful to get summoned to court of law.

REGARDING THE CASE AGAINST THE VISA CONSULTANT KINDLY NOTE THAT.
1.YOU MAY FILE A CRIMINAL CASE TO THE CHIEF JUDICIAL MAGISTRATES COURT BY MENTIONING ALL FACTS HOW YOU WERE CHEATED BY THE SAID PERSON AND ALSO PRODUCE ALL RELEVENT DOCUMENTS AND RECEIPTS TO PROVE YOUR COMPLAINT.
2.UP ON VERIFYING THE COMPLAINT AND EXAMINING THE COMPLAINENT AND HEARING THE ARGUMENTS OF ADVOCATE FOR THE COMPLAINENT THE COURT WILL ISSUE PROCESS UNDER SECTION 156 (3) OF CRPC. AGAINST THE ACCUSED AND POLICE WILL BE ORDERED TO REGISTER CRIME AGAINST THE SAID ACCUSED AND SEND THE REPORT.
3.YOU HAVE ANOTHER OPTION TO FILE COMPLAINT AGAINST ACCUSED DIRECTLY TO THE POLICE STATION BUT KINDLY NOTE THAT IN SUCH CASES WHERE MONETORY SETTLEMENT IS INVOLVED BE CAREFUL THAT THE ACCUSED PERSON MAY PLAY SOME MISCHIEF AND GET THE JOB DONE.
4.HENCE YOU FILE THE COMPLAINT TO THE COURT DIRECTLY SO THAT WHEN THE ACCUSED IS PRODUCED IN COURT IT IS UP TO YOU TO PROVE THE FACTS AND CHARGES IN COURT BY GIVING EVIDENCE AND PUNISH THE ACCUSED.
5 YOU HAVE OPTION TO WIDRAW AND COMPOUND AND COMPROMISE THE CASE IN COURT IF YOUR AMOUNT CLAIM IS FULLY SATISFIED BY ACCUSED.
