(Querist) 09 August 2013 This query is : Resolved 
I had filed a eviction suite against my tenant.
The actual suit was filed by my father who was deceased.
The rent of the tenant is only Rs.60 which he had failed to pay
since 1986.Beside this he has constructed an illegal room which the
learned court had ordered him to demolish which he didn't.The tenant
has a own flat nearby area of my said premises and he let it to other
person. He is not appearing in the court since 2009 and ex-parte
hearing has also been started. Now I want to know is there any
provision to get any compensation by auctioning his household or
by any means to recover my dues, expenses and losses?

No need for claiming compensation. First recover possession of your flat.
However if the court can pass decree for arrears rent then you can file execution case to recover it.

Once take physical possession of the property and then file execution petition against the recovery of decreed amount of rent which can definitely be recovered our of his properties if he do not depoit it to you.
