Appointment letter not issued after selection

Sir,
I have been selected for the post of Scientific Officer in a central govt. department in nov-2007 after written and a interview test. some in the selected list have already got their appointment.Two candidate immediate junior to me also got their appointment. Now the department is telling that my case is pending as there is no vacancy right now and appointment letter will be issued when any vacancy arises. Kindly guide with legal provisions.

Though it is not legal right of any selected candidate to have appointment letter in any way but your case has become otherwise wherein some junior persona have been appointed and your case is lying pending for not having vacant place. It is a good case. You may approach High court and can get mandate therefrom against department and I hope you shall get at least assurance from the department to appoint you immediately on any vacancy with compensation to you.
